1 Introduction
1.1 “We”, “our” and “us”. “You” means the customer purchasing our products. ‘’You’’ means our customers or anyone purchasing our products.
1.2 These Terms apply to all purchases made through our website, www.welshwhisk.com. We own the website and any other related products and services that refer or link to it. These terms take priority over any other terms, unless we’ve agreed otherwise in writing.
1.4 These legal terms and conditions constitute a legally binding agreement made between us and you. You agree that before using our service or purchasing from our website, you have read, understood and agreed to be bound by these legal terms.
1.5 You must not pre-order or purchase any products or use our services if you do not agree with all of these terms. You are to stop using our services immediately.
1.6 We reserve the right to modify or amend these terms and conditions at any time for any reason. It will be your responsibility to review our Terms regularly for any updates or changes that may occur. The continued use of our website will be deemed acceptance of these terms.
2 Products
2.1 The description of Products on www.welshwhisk.com is as set out on the website or any form of advertisement. Any description is for illustrative purposes only, and there may be minor discrepancies in the packaging, size and colour of the products supplied.
2.2 In the case of any products made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.
2.3 All Products which appear on the Website are subject to availability.
2.4 We reserve the right to make changes to the Products that are necessary to comply with any applicable law or safety requirement.
3 Personal Information
3.1 We retain and use all information in accordance with our Privacy Policy.
3.2 We may contact you by email or other electronic communication methods, and by pre-paid post. You agree to this by purchasing.
4 Basis of Sale
4.1 The description of the Products on our website does not constitute a contractual offer to sell the Goods. When an Order has been submitted on the website, we reserve the right to reject it for any reason. We will provide you with the reason as soon as possible.
4.2 The order process is set out on the website. Each step allows you to check and amend any errors before submitting the order. It is your responsibility to check that you have used the ordering process correctly.
4.3 A Contract will be formed for the sale of Products ordered only when you receive an email from us confirming the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors (orders@welshwhisk.co.uk). We are not responsible for any inaccuracies in the Order placed by you. By placing an Order, you agree to us providing you with confirmation of the Contract by email, which will include all relevant information (i.e., the Order Confirmation). You will receive the Order Confirmation within a reasonable time after making the Contract, but in any event not later than the delivery of any Products supplied under the Contract.
5 Price and payment
5.1 The price of our Products and any additional delivery or other charges is that set out on the website at the date of the order or such other price as we may agree in writing.
5.2 Payments are processed securely at the time of ordering. Once your order is confirmed, it cannot be amended or cancelled.
5.3 We reserve the right to amend or change the prices of products.
5.4 You must pay by submitting your credit or debit card details with your order. We can take payment immediately or before delivery of the products.
6 Delivery, refunds and Cancellation
6.1 We will deliver the products to the Delivery Location by the agreed time or within the agreed period, or, failing any agreement, without undue delay, and in any event, no more than 7 days after the day on which the Contract is entered into.
6.2 In any case, regardless of events beyond our control, if we do not deliver the products on time, you can (in addition to any other remedies) treat the Contract as at an end if:

We have refused to deliver the products, or if delivery on time is essential, taking into account all the relevant circumstances at the time the Contract was made, or you said to us before the Contract was made that delivery on time was essential; or
-
After we have failed to deliver on time, you have specified a later period which is appropriate to the circumstances, and we have not delivered within that period.
6.3 You, as the customer, are responsible for ensuring delivery details are entered correctly. Incorrect address details do not constitute grounds for a refund or replacement. If any changes need to be made, you must email orders@welshwhisk.co.uk within 24 hours of placing an order with any corrections.
6.4 As our products are perishable food items, we do not offer refunds. We will, however, offer replacements in the following situations:

If your bakes are severely damaged upon arrival.

In cases of significant delivery delays that affect the freshness or quality.
6.5 Minor or cosmetic damage (e.g., slight cracks or smudging) does not qualify for a replacement. If you dislike the taste of a product, this is considered subjective and does not qualify for a refund or replacement. Replacements will only be issued once the original parcel is returned to us.
6.6 If you believe there’s an issue with your order, you must contact us at orders@welshwhisk.co.uk within 48 hours of delivery.
6.7 The products will become your responsibility from the completion of delivery or customer collection. You must, if reasonably practicable, examine the products before accepting them.
6.8 If you have placed an order with us and wish to cancel or change the delivery address, you must do so within 24 hours of placing your order. We cannot cancel or amend orders after this time, as items are baked to order and are perishable.

To request a cancellation or amendment, you must email orders@welshwhisk.co.uk and use the email subject title as ‘Cancel Order’ or ‘Amend Order’. This ensures we can act fast.

Refunds may take between 1 and 10 days to process, depending on your payment provider.

If you have received products in connection with the Contract which you have cancelled, you must send back the products or hand them over to us at 3 Ffordd Celyn, Lon Parcwr Business Park, Ruthin, LL151NL without delay and in any event not later than 14 days from the day on which you communicate to us your cancellation of this Contract. The deadline is met if you return the products before the 14-day period has expired. You agree to bear the cost of returning the products.
7 Risk and Title
7.1 Risk of damage to, or loss of, any products will pass to you when the products are delivered to you.
7.2 You do not own the products until we have received full payment.
8 Allergens
8.1 All major allergens are present in our kitchen. This includes, but is not limited to: nuts, gluten, dairy, eggs, and soya.
8.2 While we take every precaution to avoid cross-contamination, we cannot guarantee that any of our products are free from allergens. Customers with severe allergies are advised to refrain from ordering.
9 Privacy
9.1 Your privacy is of the utmost importance to us. We respect your privacy and comply with the General Data Protection Regulation (GDPR) regarding your personal information.
9.2 These Terms and Conditions should be read in conjunction with and are in addition to our policies, including our Privacy Policy.
9.3 For these Terms and Conditions:

'Data Protection Laws' means any applicable law relating to the processing of Personal Data, including, but not limited to, the GDPR.

'GDPR' means the UK General Data Protection Regulation.

'Data Controller', 'Personal Data' and 'Processing' shall have the same meaning as in the GDPR.
9.4 Where you supply Personal Data to us so we can provide products to you, and we Process that Personal Data in the course of delivering the products to you, we will comply with our obligations imposed by the Data Protection Laws:

Before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;

We will only Process Personal Data for the purposes identified.

We will respect your rights about your Personal Data; and

We will implement technical and organisational measures to ensure your Personal Data is secure.

10 Excluding Liability
10. 1 The Supplier does not exclude liability for:
(i) any fraudulent act or omission; or
(ii) for death or personal injury caused by negligence or breach of the Supplier's other legal obligations.
Subject to this, the Supplier is not liable for (i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (ii) loss (eg loss of profit) to the Customer's business, trade, craft or profession which would not be suffered by a Consumer - because the Supplier believes the Customer is not buying the products wholly or mainly for its business, trade, craft or profession.
